How to Enter

To participate, entrants must take a video of the fun they have with their Pillow Pets^TM plush folding stuffed animals this summer – whether on vacation, at camp or in their own backyard, and upload it to a video-sharing website and send the link to MyPillowPetsAdventure@carabinerpr.com. Videos will be accepted between May 24 and July 31, 2010. Each winner will be chosen at random between May 31 and August 22, 2010, and will be notified via e-mail.

Eligibility
All official entrants who upload the video to the video-sharing website of their choice must be at least 21 years of age and a legal resident of the U.S. Employees and immediate families or household members of CJ Products, LLC, and its affiliates are not eligible to enter. CJ Products is not responsible for any lost, late, illegible, incomplete or misdirected email, any electronic miscommunications or failures, technical hardware or software failures of any kind, lost or unavailable network connections, or failed incomplete, garbled or delayed computer transmissions which may limit an entrant's ability to participate in the giveaway.

There is a limit of one entry per email address, per person. Duplicate entries will be void. By entering an email address, entrant consents to receiving additional My Pillow Pets promotional information. All entrants agree to abide by these Official Contest Rules. All entries become the property of CJ Products.

Selection

Videos will be accepted between May 24 and July 31, 2010. One winner will be chosen at random every three weeks between May 31 and August 22, 2010, and will be notified via e-mail. All decisions of CJ Products are final and binding on the entrants in all respects. Odds of winning will be determined by number of entries received. Each selected winner will be given fourteen (14) business days from the first day of notification to respond to claim prize. Winners must contact CJ Products after notification and make arrangements for prize delivery. A non-response by the selected winner or non-receipt of notification response after the specified fourteen (14) business days will be considered winner's forfeiture of the prize, and an alternate winner may be selected from the pool of eligible entries. If an entrant is found to be ineligible, an alternate winner may also be selected from the pool of eligible entries.

Prize
Each winner will receive a Pillow Pets plush folding stuffed animal of his or her choice, plus one each for up to ten friends. CJ Products reserves the right to substitute a prize of equal or greater value. No transfer, change, or substitution of the prize is permitted. Other restrictions may apply. Entries and prizes are nontransferable.

General Conditions and Releases

The contest is void where prohibited or restricted by law in the United States and in all other countries and is subject to all United States and other countries’ federal, state and local laws and regulations.

Unless prohibited by law, acceptance of prize constitutes granting consent to CJ Products the right to reproduce the story, quotes, individual names, likeness and photograph(s) for use in editorial advertising, marketing and public relations projects. This information will be provided at no cost to CJ Products. All materials will become the property of CJ Products. By entering or accepting a prize in the giveaway, the winner agrees to be bound by these Official Contest Rules and to conform to all federal, state and local laws and regulations. The winner may be required to execute and return to CJ Products within 14 days an Affidavit of Eligibility and a Liability and Publicity Release to be eligible for the prize, or an alternate winner may be selected. Applicant may be required to furnish proof of identity in order to receive the prize.

By entering, participants agree to release and hold harmless CJ Products, its subsidiaries and affiliated entities, directors, officers, employees, attorneys, agents, and representatives from any damage, injury, death, loss, claim, action, demand, or other liability that may arise from their acceptance and/or use of any prize or their participation in this giveaway.

CJ Products is not responsible for 1) failed, returned or misdirected notifications based on inaccurate information provided by the winner on the entry form; or 2) entries and responses to winner notifications which are lost, late, incomplete, illegible, unintelligible, misdirected, damaged or otherwise not received by the intended recipient in whole or in part, or for computer or technical error of any kind. CJ Products reserves the right, in its sole discretion, to cancel or suspend this giveaway and prize drawing should a virus, "bug" or other cause beyond CJ Products’ control corrupt the administration, security or proper administration of the giveaway.

CJ Products, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the website or who is otherwise in violation of the rules. Any person attempting to defraud or in any way tamper with this giveaway will be ineligible for prizes and may be prosecuted to the full extent of the law. CJ Products reserves the right to modify the rules of the giveaway in any way or at any time. This giveaway shall be governed by and construed under the laws of the State of California, without giving effect to its conflict of law principles. By participating in this contest, entrants agree that California courts shall have jurisdiction over any dispute or litigation arising from or relating to this giveaway and that venue shall be only in San Diego County, CA.

PUBLICITY RELEASE

 

As legal guardian of the minor named below, I hereby grant to CJ Products permission to tape and photograph the minor and to record the minor’s voice and conversation, including quotes, paraphrases, and sounds recorded (“Appearance”) relating to My Pillow Pets. I agree that CJ Products shall be the exclusive owner of all copyright and other rights in and to all tangible works incorporating any or all of the Appearance, and will be able to perpetually use and license to third parties such tangible works for its business purposes.  I understand and agree that CJ Products will not pay the minor in connection with the minor’s Appearance or CJ Products’ use or commercial exploitation thereof.

 

I hereby grant to CJ Products an irrevocable, non-exclusive, fully paid-up, royalty-free, worldwide right and license to use and to authorize others to use, all or part of the minor’s name, gender, age, voice, image, likeness and any biographical facts which may have been provided by me in any material derived therefrom, all of the foregoing for CJ Products’ business purposes. 

 

I hereby forever release and discharge CJ Products, its parent, affiliates, agents, employees, contractors, volunteers, attorneys, licensees, successors, predecessors and assigns, from any and all actions, counter or cross actions, causes of action, claims, demands, damages, costs, attorneys’ fees and expenses of any kind whatsoever (collectively “Claims”), which may now or hereafter exist, including but not limited to, Claims relating to the rights of privacy and publicity and arising out of or related to CJ Products and use of the Appearance, or any part thereof, in accordance with this agreement.  I further agree that I shall be liable for any reasonable outside attorneys’ fees and costs incurred by CJ Products in connection with any claim or lawsuit brought by me/the minor or on behalf of me/the minor in violation of this agreement.  In no event shall I or the minor have the right to enjoin the development, production or distribution or exploitation of material incorporating any or all of the Appearance.  CJ Products may transfer, assign or sublicense its rights under this agreement or all or any of its rights or privileges hereunder to any entity or individual without restriction. This release shall be binding on all of my successors-in-interest and heirs.  This agreement sets forth the entire agreement between us with respect to the subject matter hereof and may not be altered or amended except in writing signed by both parties.  This agreement shall be governed by the laws of the states of California. The parties hereto agree to submit to jurisdiction in Oceanside, California.   

 

The foregoing is in consideration of the opportunity to participate in the Appearance.
